TERMS AND CONDITIONS of PERK DHAMAKA RETAILER PROMO

This “Perk Dhamaka Retailer Promo” (hereinafter referred to as "Campaign") is an initiative of Mondelez India Foods Private Limited having its registered office at Unit No 2001, 20th Floor, Tower-3 Wing-C, One International Center Parel, Mumbai- 400 013 (“Mondelez”). Please read these terms and conditions ("T&Cs") before participating in this Campaign. This Campaign is only applicable for Retailers purchasing Perk, as per the conditions set out here. 
1.1. The Campaign is subject to all applicable central, state and local laws and regulations in India. 
1.2. Mondelez reserves the right to exclude or disqualify any Retailers from the Campaign on grounds of: (a) misconduct or criminal record or acted or have the intention to act in a dishonest or fraudulent manner or in bad faith; (b) tampering with the entry process or the operation of the Campaign; (c) acting in violation of these T&Cs; (d) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person; (e) entries being offensive, distasteful, unacceptable or against the ethos and principles of Mondelēz  or which may be considered disparaging; or (f)for any other reasons, as it may deem fit and proper.

2. DETAILS OF THE CAMPAIGN AND HOW TO ENTER:
1. Campaign Period: This Campaign will commence from 00:01 a.m. 1st May 2025 and end at 11:59 p.m. on 14th July 2025 ("Campaign Period"). Any entries before or after the Campaign Period will not be considered. We reserve our right to cancel/modify/extend the Campaign Period or the T&Cs applicable. No claims/questions shall be entertained in this regard. 

2. How to Participate
2.1. Retailers to scan the QR code printed on the promo pack or visit perkdhamaka.com. 
2.2. Retailers to register themselves with the unique code printed inside the promo pack along with their name, mobile number, email ID, and state. Retailers that belong to the state of Tamil Nadu must also answer a skilled-based question to complete their registration and enter the contest. 
2.3. Retailers to authenticate their mobile numbers with the OTP received on their registered mobile number.
2.4. Retailers to choose the preferred option (NEFT/UPI/e-Wallet) and submit the details to claim the cashback. Retailers will receive cashback within 24-48 business hrs. Retailers also stand a chance to win mega rewards.

3. PRIZES:
3.1. Prizes: Participants shall be eligible to win the following Prizes (“Prizes”):

a) Assured Cashback of Rs. 5, or Rs.10, or Rs.20 on purchase of promo pack of Perk SKUs listed below:

(i) All cashback winners will receive the cashback on every purchase of the promo pack.
(ii) The mega and weekly reward winners will be chosen randomised basis from on valid participation from Retailers from Rest of India. 
(iii) Any Retailer can win a maximum of 1 (one) reward during the Campaign Period (i.e. any participant who has won a weekly prize or Cashback Prize of Rs.10000 will not eligible to win any further prize during the campaign period.

a) The eligibility of retailers for the Kitchen Appliances Voucher shall be determined based on the uniqueness and creativity demonstrated in their responses to the questions ‘’What you love about the new Perk?”.

3.2. All applicable taxes resulting from acceptance of Prize(s) shall be the responsibility of Prize Winner.
3.3. The Prizes are non-transferable, non-assignable, non-substitutable and under no circumstances will be exchanged for cash.

4. MISCELLANEOUS:
4.1. This Campaign is being made purely on a "best effort" basis and participation in this Campaign is at your sole discretion and on a voluntary basis. 
4.2. The courts of competent jurisdiction at Mumbai shall have sole and exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Campaign. Participation in the Campaign is unauthorized in any jurisdiction that does not give effect to all provisions of these T&Cs, including (without limitation) this clause.
4.3. Please also visit the Privacy Notice of Mondelez the Campaign Home Page where these T&Cs are posted, to understand and acknowledge what we do with the information including personal data. 

5. Specific Terms & Conditions – Merchandise 
5.1. Campaign Partner will ensure to supply product merchandise in good condition, However Campaign Partner & Mondelez shall not be liable/responsible for any defect in the product. The guarantee and warranty of the product shall be transferred, as received from the Manufacturer / Distributor.
5.2. The operational part of the scheme like handling and distribution of Prize, shall be managed by the Campaign Partner. However, promo product (promo packs of chocolates) will be distributed by Mondelez.
5.3. Product will be delivered within 45 business days after the details have been confirmed by winner to Campaign Partner.
5.4. Any complaints regarding the non-delivery of the product should be made within 7 days from the time of dispatch (intimated through E-mail/SMS) of the products by Campaign Partner.
5.5. As a practice, courier companies try to deliver the product 2 times to the customer if at the first instance courier company couldn’t reach the customer for various of reasons such as (not limiting to) not at home, phone switched off, change of delivery address, wrong address etc. If the product is returned in such cases, Premier Sales Promotions Pvt. Ltd. will not be liable to dispatch the product again.
5.6. Any dispute arising out of or in connection with or as a result of the facility shall be subject to the exclusive jurisdiction of the courts of Mumbai only.
5.7. Product once delivered cannot be replaced under any circumstances.
5.8. Campaign Partner will offer product warranty in case it is offered by manufacturer/distributor and all claims towards warranty need to be taken up with the manufacturer/distributor directly.
5.9. No request for change in color, size, model etc. will be entertained by Campaign Partner or Mondelez.

6. Specific Terms and Conditions – Cashback
6.1. This offer entitles the end user cashback on their Online Wallet or Bank Account Or UPI. The Retailers will be responsible for their choice of the cashback transfer method. The denomination of the cashback will be mentioned on the voucher/scratch card.
6.2. Any Retailers that purchase the promotional product shall be eligible to receive a cashback. The Retailers shall receive a cashback of an amount equivalent to the value as mentioned in the Voucher (“Cashback/Voucher Amount”). 
6.3. By redeeming the Offer provided on the same, a participant agrees to be bound by the terms and conditions below (“Conditions”).
6.4. These Conditions apply to every person ("Participant”) redeeming the offer given by Premier Sales Promotions Pvt Ltd, No claim shall lie for any redemption requests made after the expiry of the Offer Period.
6.5. If you are not a wallet partner registered Retailers, you will be required to register on the wallet partner website or Mobile App to receive your wallet cashback.
6.6. The Retailers will be responsible for entering details such as UPI ID, Account No, Online Wallet Mob Nos, etc. Premier Sales Promotions Pvt Ltd. will not be responsible for any incorrect entries or details on the promotion website. No change in details will be entertained once you have submitted the booking.
6.7. All Participants agree that wallet partners offering discount vouchers may at any time stipulate additional terms and conditions for redemption of the discount vouchers and such terms and conditions shall be binding on the Participants and shall apply to every redemption of recharge/discount voucher by the Participants.
6.8. The Wallet Partner holds the right to refuse transactions deemed fraudulent as per their policies.
6.9. In the event of any fraud detection, the wallet partner reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.
6.10. The Participant acknowledges that relevant state and central taxes may be deducted by the merchant while redeeming the discount offer and therefore, the amount reflected in the voucher may not be the same as the final redemption value received by the Participant.
6.11. In no event shall Premiere Sales Promotions Pvt Ltd or its partner agency be held liable for any issues relating to the redemption of the voucher including redemption requests not being honored by the wallet partner.
6.12. In no event shall the maximum liability exceed the value of the voucher as the case may be.
6.13. Any disputes or differences in connection with the offer shall be governed by laws of India and shall be subject to the exclusive jurisdiction of the Courts at Bengaluru.
6.14. The wallet partner reserves the right to restrict cashback for any account with suspicious behavior or invalid details/credentials. The wallet partner has the right to ask for documents to prove the Retailers/user's identity.
6.15. This offer is subject to promotional availability.

7. General Terms & Conditions:
7.1. This offer is not available to employees, consumers, distributors of Mondelez India Foods Private Limited and Premier Sales Promotions Pvt. Ltd., its clients or agencies, and their immediate families.
7.2. This offer is subject to promotional availability. This offer is not exchangeable for “cash”.
7.3. This offer is not for sale.
7.4. This voucher has no monetary value, is non-transferable, and cannot be used in conjunction with any other promotional offers.
7.5. The usage of this voucher is incumbent upon the terms & conditions to be followed by the voucher holder/purchaser. Such conditions need to be followed by the voucher holder/purchaser.
7.6. Only one voucher per booking will be entertained. Multiple Vouchers cannot be booked together.
7.7. If you are registered with Do Not Disturb (DND) service, you will not receive an SMS confirmation from us. Please mail us at feedback@bigcity.in for any queries. If Premier Sales Promotions Pvt. Ltd has already emailed or sent by SMS, Premier Sales Promotions Pvt. Ltd will not re-send the voucher code to any new or corrected email address or phone number nominated by the entrant.
7.8. The “How to Redeem” instructions form a part of these Terms & Conditions. For detailed T&C’s please visit Perkrewards.bigcityexperience.com. Any costs associated with entering the promotion, including accessing the promotional website, are the responsibility of each entrant. Also, regular call and message rates will apply as per the consumer telecom operator in their respective circles.
7.9. MONDELEZ INDIA FOODS PRIVATE LIMITED or Premier Sales Promotions Pvt. Ltd. is not responsible in case the Voucher codes have expired for any reason whatsoever.
7.10. MONDELEZ INDIA FOODS PRIVATE LIMITED or Premier Sales Promotions Pvt. Ltd and the Stores are not responsible for any loss or theft of the Vouchers.
7.11. No duplicate Voucher shall be issued to the Retailers.
7.12. MONDELEZ INDIA FOODS PRIVATE LIMITED Or Premier Sales Promotions Pvt. Ltd. is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
7.13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any Retailers; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
7.14. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.
7.15. Caution: Any attempt to deliberately damage the Promoter's promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages, and costs.
7.16. MONDELEZ INDIA FOODS PRIVATE LIMITED Or Premier Sales Promotions Pvt. Ltd. accepts no responsibility, financial or otherwise for the misuse of Premier Sales Promotions Pvt. Ltd. Vouchers and are not liable for any personal loss or injury and cannot be held responsible for any disagreement concerning the quality/ availability of featured offers. Premier Sales Promotions Pvt. Ltd., its clients, agents, and distributors cannot replace any lost, stolen or damaged Vouchers and reserve the right to withdraw or amend any details and/or prices without notice.
7.17. Premier Sales Promotions Pvt. Ltd. is acting as an executing agency for this promotional offer and holds no legal and financial liability on unclaimed offers, incentives, Vouchers, etc beyond the applicable period of the promotional offer.
7.18. MONDELEZ INDIA FOODS PRIVATE LIMITED does not endorse the quality of any of the products or services being offered as Vouchers under the Offer. Any complaints or queries pertaining to the same would have to be taken up directly with the Premier Sales Promotions Pvt Ltd. of such a product or service.
7.19. The Terms and Conditions of the offer can be changed during the promotional period by PREMIER SALES PROMOTIONS PVT LTD or by MONDELEZ INDIA FOODS PRIVATE LIMITED
7.20. These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in Bangalore.
